This has been replaced in our library October 2012. This document is no longer available on the ICO site - this is the text as downloaded in 2010. The fact that guidance is no longer available suggests that the ICO is less and less willing to stick its neck out where there might be legal issues arising from it giving wrong advice. So please note this is NOT current ICO advice at the time of writing.
This is not as definitive as one might like as regards use for empty homes work. The gist of it seems to be we will not take enforcement action (= prosecution?) unless is detrimental to the person affectded. Hmmm..
